Apple Prevents Samsung Galaxy Tab 10.1 to be Sold in Germany – UK Next?
Samsung isn’t going to be too pleased but Apple has won a significant victory against the alleged copycat tactics used to create the Galaxy Tab 10.1.
A German court granted a preliminary injunction against Samsung’s Galaxy Tab 10.1 on Tuesday based on claims that the Galaxy Tab 10.1 blatantly copied the iPad’s design, which is registered with the European Union. The ruling applies immediately in Germany – the thing is that Apple could have the injunction granted EU-wide which would totally stuff Samsung’s global pedaling of the Honeycomb-powered slate.
The Landgericht Düsseldorf ruling is based on alleged violation of a European Community design registration for the iPad. Samsung must now stop any sales of the Galaxy Tab 10.1 in Germany – and, as the registration is filed with the EU, this injunction can be enforced in every EU member country except the Netherlands; that’s because the intellectual property laws are different there.
This is all a follow-up on Apple’s original attack of Samsung’s “copying” of the iPhone and iPad’s hardware and user interface used for its Android phones and tablets. Apple cited patent infringement, design patent infringement, trademark violation, and trade dress violation in the US lawsuit.
Apple stated in their case: “Rather than innovate and develop its own technology and a unique Samsung style for its smart phone products and computer tablets, Samsung chose to copy Apple’s technology, user interface and innovative style in these infringing products,”
This sparked Samsung to fight back with lawsuits in Asia, Europe as well as the US.
The legal-eagles at Apple and Samsung have so far filed complaints in 11 courts across 9 countries!
